DRAFT: this text is a starting point, not legal advice. It must be reviewed by a South African attorney, and the highlighted details filled in, before WISPMap takes on paying customers.
Terms of service
These terms apply to your organisation's use of WISPMap, a service provided by [company name and registration number] ("we", "us"). By creating an account or using the service, you agree to them on behalf of your organisation.
1. The service
WISPMap monitors network equipment that you are entitled to monitor. It uses a collector that you install in your own network, and it shows status, history and alerts. During the beta, the service is free, it may change, and features may be added or removed.
2. Your responsibilities
- Only monitor networks and devices you own or are authorised to manage.
- Keep your login details and collector tokens secret, and tell us about any unauthorised use.
- Give the collector a read-only router account. You are responsible for the configuration of your own equipment.
- Don't try to access other organisations' data, overload the service, or reverse engineer it (the collector, which is open source, is licensed separately under Apache 2.0).
3. Alerts are best effort
WISPMap helps you notice problems sooner, but it is not a guarantee that every fault will be detected or that every message will arrive. Email and Telegram delivery depends on third parties. Don't rely on WISPMap as your only safety or emergency measure.
4. Availability
We aim for high availability but don't promise uninterrupted service, especially during the beta. Planned maintenance is announced where possible.
5. Your data
Your organisation owns its network data. We process it only to provide the service, as described in the privacy policy. You can export it or ask us to delete it at any time.
6. Fees
The beta is free. Before any paid plan applies to you, we will tell you the price and you must agree to it. Until then, nothing is charged.
7. Liability
To the extent the law allows, the service is provided "as is". We are not liable for indirect or consequential loss (for example lost revenue during an outage we didn't alert you to). Our total liability is limited to [e.g. the fees you paid in the last 12 months, or R1 000 during the free beta]. Nothing in these terms limits rights you have under the Consumer Protection Act where it applies.
8. Ending the service
You may stop using WISPMap and close your account at any time. We may suspend accounts that break these terms, after notice where reasonable. Data deletion after closure is described in the privacy policy.
9. Law
These terms are governed by the laws of the Republic of South Africa.
